Digital Millennium Copyright Act Notice

EW Motion Therapy respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our website or services.

If you believe that content on our website infringes your copyright, please notify us by following the procedures outlined below. We will investigate valid claims and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Filing a DMCA Copyright Infringement Notice

If you are a copyright owner or authorized to act on behalf of one, and you believe that material on our website infringes your copyright, you may submit a written notification to our designated DMCA agent. Your notice must include all of the following information:

6. Your Signature Include your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).

What Happens After You Submit a Notice

Upon receiving a valid DMCA notice that complies with the requirements above, we will:

  1. Review the notice to confirm it contains all required information
  2. Investigate the claim in good faith
  3. Remove or disable access to the allegedly infringing material if we determine the claim is valid
  4. Make reasonable efforts to notify the user who posted the material (if applicable) that we have removed or disabled access to the content
  5. Maintain records of the notice and our response as required by law

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees incurred by us, the alleged infringer, or any copyright owner or licensee injured by such misrepresentation.

Counter-Notification Procedure

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include all of the following:

1. Identification of the Removed Material Identify the material that was removed or disabled and the location where it appeared before removal. Include the specific URL or page where the material was located.

2. Your Contact Information Provide your name, mailing address, telephone number, and email address.

3. Consent to Jurisdiction Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the Northern District of Alabama), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

4. Good Faith Statement Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

5. Your Signature Include your physical or electronic signature.

What Happens After You Submit a Counter-Notification

Upon receiving a valid counter-notification, we will:

  1. Promptly provide the original complaining party with a copy of your counter-notification
  2. Inform the complaining party that we will restore the removed material in 10 to 14 business days, unless we receive notice that they have filed a court action seeking to restrain you from engaging in the allegedly infringing activity
  3. Restore the removed material between 10 and 14 business days after receiving the counter-notification, unless we receive notice of a court action from the original complaining party

Please be aware that filing a counter-notification may lead to legal proceedings between you and the complaining party. Consider consulting with an attorney before submitting a counter-notification.

Repeat Infringer Policy

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

We reserve the right to modify this DMCA Policy at any time. Any changes will be effective immediately upon posting the revised policy on our website with an updated "Last Updated" date. We encourage you to review this policy periodically.
